1. SERVICES PROVIDED
Provider agrees to perform the following marketing and software services for the Client on a month-to-month basis:
1.1 Marketing Services
Running Meta (Facebook) ads to generate leads for Client’s business.
Building and maintaining a Facebook ad campaign and lead capture funnel.
Setting up and optimizing ads, funnel pages, and surveys/forms.
Providing follow-up text and email campaigns, including ad creatives, thank-you videos, and automation sequences.
Researching and forming an overall marketing strategy tailored to Client’s business.
Ongoing optimization of ads and funnels.
1.2 Software Services
Providing access to Provider’s proprietary CRM and lead management system ("R8SIX CRM").
Providing an autodialer with optional automation workflows.
Enabling automation workflows for SMS auto-responders, voicemail drops, and email campaigns.
2. OWNERSHIP AND ACCESS RIGHTS
2.1 Client’s Rights:
Client owns all leads generated from the campaign and will have access to them through the CRM while subscribed.
Leads will be directly placed into the CRM provided by Provider.
2.2 Provider’s Rights:
Provider retains ownership of all funnel pages, surveys, forms, automated workflows, ad copy, and any other intellectual property created within the software.
The Client’s access to Provider’s proprietary materials and automation tools is only available while actively subscribed.
If Client terminates or fails to pay, access to funnels, CRM, automations, and other software-related components will be revoked immediately.
3. FEES AND PAYMENT TERMS
Client agrees to pay the following fees for services:
Marketing Services: $500/month (includes funnel pages, dedicated email, ad management, and optimization)
Starter Power Dialer: $50/month
Advanced Power Dialer: $199/month (includes advanced workflows, SMS auto-responders, voicemail drops, and email campaigns)
Additional Usage Fees:
Outbound voice calls: $0.018/minute
Inbound voice calls: $0.0085/minute
SMS (inbound and outbound): $0.0079/text
Call recording: $0.0025/minute
Emails sent: $0.675 per 1,000 emails
3.1 Payment Schedule:
Payments are due in full on the due date each month.
If payment is not received on the due date, services will be paused immediately and will remain paused until full payment is received.
No prorated refunds or adjustments will be made for any lost leads or campaign disruptions due to non-payment.
Client is responsible for all Meta ad spend, which is paid directly to Meta.
4. AD SPEND AND BUDGET
Client is responsible for funding the Meta ad spend separately from Provider’s fees.
Recommended starting budget: $20/day for 5 days, then increase by $10/day every few days.
Provider will assist in optimizing ad spend but does not guarantee any specific cost per lead or overall results.
5. RESULTS DISCLAIMER
Provider does not guarantee any specific number of leads, sales, signups, or revenue increases.
Client understands that results vary based on factors such as business model, sales processes, follow-ups, and market conditions.
The Client assumes full responsibility for following up on leads and converting them into sales.
6. TERMINATION AND REFUND POLICY
This Agreement is month-to-month and can be canceled at any time by the Client.
There are absolutely no refunds for any reason.
Upon cancellation:
Ad management will cease immediately.
Provider will no longer support any Meta ad-related issues.
CRM access, funnel pages, automation workflows, and all proprietary systems will be revoked.
7. ADDITIONAL SERVICES AND MODIFICATIONS
Any additional marketing, advertising, consulting, video production, search engine optimization, or services not explicitly covered in this Agreement must be requested separately.
Any additional work will require a contract addendum and full payment before commencement.
8. LIMITATION OF LIABILITY
Provider shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from the use of its services.
Provider is not responsible for losses due to campaign interruptions, lead loss, or failure of the Client to convert leads.
Client acknowledges and agrees that they assume full responsibility for the outcomes of using Provider’s services.
9. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by the laws of the State of Utah.
Any disputes arising from this Agreement shall be resolved through binding arbitration in Utah County, Utah.
10. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral. Any modifications must be in writing and signed by both parties.
By subscribing to Provider’s services, the Client acknowledges that they have read, understood, and agreed to the terms of this Agreement.
